Purpose

The purpose of this policy is to establish clear guidelines for renting, maintaining, and managing booth spaces at Westside Market. By adhering to these guidelines, we ensure a high-quality shopping experience and maintain consistency across all vendor spaces.

1. Definition and Purpose of Booth Spaces

Booth spaces at Westside Market are designated rental areas provided to vendors to display and sell their products. These spaces are rented on a contractual basis and are subject to guidelines to maintain the integrity, appearance, and quality of the market.

2. Rental Agreement and Contract Terms

A. Contract Duration

  • All booth rental contracts have a fixed term of 6 months, beginning on the 1st day of the month.
  • The contract is renewable upon expiration, on month to month basis, subject to review and agreement between the vendor and management.

B. Marketing Fee Payment

  • Marketing Fee is due on the 1st day of each month. Late payments will incur a 10% late fee if not received by the 5th of the month.
  • All marketing fee payments must be made via credit card only.
  • Monthly Fee will include a Marketing Fee, which covers store promotions and marketing efforts.

C. Security Deposit

  • refundable security deposit equal to one month’s rent is required at contract signing.
  • The deposit will be refunded at the end of the contract term if the booth is vacated in good condition and no outstanding rent or fees remain.

3. Booth Space Utilization

A. Booth Design and Setup

  • Vendors are responsible for setting up their booth spaces in a visually appealing and professional manner.
  • Store management reserves the right to reject booth setups that do not meet aesthetic or safety standards.

B. Display and Merchandise Guidelines

  • All items displayed must be clean, organized, tagged, priced and visually appealing.
  • Booths must remain stocked and maintained at all times.
  • Merchandise should be clearly priced and labeled with Westside Market SKU number tags.
  • Vendors are encouraged to refresh their booth with new items regularly to maintain customer interest.

C. Prohibited Items

  • No illegal, unsafe, or counterfeit goods may be displayed or sold.
  • No offensive or inappropriate content in displays or signage.
  • Management reserves the right to remove any item deemed inappropriate or in violation of store policy.

4. Maintenance and Cleanliness

A. Vendor Responsibilities

  • Vendors are required to keep their booth space clean and organized at all times.
  • Regular maintenance, including dusting and rearranging, is expected.
  • Booths must be kept free of clutter and hazardous materials.
  • Any damages to the booth or store property must be reported immediately.

B. Store Management Responsibilities

  • Store management will conduct weekly inspections to ensure compliance with cleanliness and maintenance standards.
  • If issues are found, the vendor will be notified and given 5 business days to resolve the problem.
  • Failure to comply with maintenance requirements may result in fines or contract termination.

5. Booth Assignment and Relocation

  • Booth assignments are at the sole discretion of Westside Market management.
  • Management reserves the right to relocate vendors as needed to optimize the store layout or accommodate business needs.
  • Vendors will be given a minimum of 14 days’ notice before any relocation.
  • Any costs associated with relocating will be borne by the vendor.

6. Shared Booth Spaces

A. Approval and Contract

  • Shared booths are allowed only with prior written approval from store management.
  • Each member in a shared booth must sign an individual contract, with one member designated as the primary contract holder.
  • Both members are responsible for maintaining the shared space and adhering to all policies.

B. Financial Responsibilities

  • The primary contract holder is responsible for the entire marketing fee.
  • Secondary members will not have direct financial responsibility for the marketing fee but must adhere to all booth policies.
  • Failure to comply with payment obligations may result in payouts being held for both members until the balance is settled for all members at said booth.

7. Marketing and Promotion

Westside Market conducts regular marketing and promotional activities to attract customers. Vendors are encouraged to:

  • Participate in store events and promotions.
  • Collaborate with management on promotional ideas.
  • Update merchandise to reflect current trends and customer preferences.

8. Insurance and Liability

  • Vendors are encouraged to obtain general liability insurance to protect against theft, damage, or personal injury claims.
  • Westside Market is not responsible for any loss, theft, or damage to vendor merchandise or property.
  • Vendors assume full responsibility for any accidents, injuries, or claims arising from their booth space.

9. Contract Termination and Exit Policy

A. Early Termination

  • Vendors may terminate their contract early with 30 days’ written notice.
  • Early termination may result in forfeiture of the security deposit.

B. Store-Initiated Termination

  • Westside Market reserves the right to terminate contracts without notice if the vendor violates store policies or fails to meet financial obligations.
  • In the event of termination, the vendor must vacate the space within 7 days.

C. Booth Clearance

  • Upon termination or expiration, vendors must clear their booth space within the specified time frame.
  • Any remaining items will be considered abandoned and subject to disposal or sale at the store’s discretion.

10. Compliance and Enforcement

Failure to comply with this policy may result in:

  • Verbal or written warnings.
  • Fines or penalties for non-compliance.
  • Immediate termination of the rental agreement.

11. Dispute Resolution

  • Any disputes arising from booth rental or policy enforcement will be addressed through formal mediation, as outlined in the vendor agreement.
  • Disputes must be reported in writing to store management for review.

12. Amendments and Updates

  • Westside Market reserves the right to update or modify this policy at any time.
  • Vendors will be notified of any changes at least 30 days in advance.

13. Acknowledgment and Signature

All vendors are required to sign an acknowledgment form indicating that they have read, understood, and agreed to comply with the Booth Space Rental Policy.
